Privacy Policy

Your privacy is important to us and we don’t ask for information unless we truly need it to provide you with the best experience possible while using our services. This Privacy Policy applies to all users worldwide and addresses applicable privacy laws, including PIPEDA (Canada), GDPR (EU), and COPPA (U.S.) for children under 13.

1.0 What We Collect

1.1 Organization Information

Organization Information is information about the team, club, or organization that you represent. We collect this information to set up accounts, manage teams, and provide SkiCam services effectively. Over the course of providing our services, we may ask for:

  • contact information, such as your organization name, address, and "home" mountain; and
  • financial information, such as your billing information.

We collect this information in order to provide our services to your organization, generally directly from your team representatives or account administrators. We may request this information specifically, or collect it through your organization’s engagement with our services. We do not sell or otherwise dispose of your organization’s data.

1.2 Personal Information

Personal Information is information that can be used to identify you as an individual, either alone or taken with other information we collect. Over the course of providing you the services, we may ask for:

  • contact information, such as your name, phone number, and email address;
  • account details, including login credentials and profile information;
  • date of birth, which may be used to verify age for compliance with applicable laws and to provide age-appropriate features; and
  • location information, including your address, IP address, and device-based location data.

We collect this information in order to provide our services to you, generally directly from you. We may request information specifically, or we may collect it through your engagement with certain aspects of our services. We do not sell or otherwise dispose of your data.

1.3 Non-personal Information

Non-personal information is information that cannot be used to identify you as an individual, either because it is insufficient to identify you without being combined with other collected data, or because it has been aggregated and anonymized so that it cannot be used to identify you. We collect certain non-personal information to automatically improve our services. This may include your device, operating system, browser type, your click information, and other information we can use for analytics.

2.0 What We Do With Your Information

2.1 Use of Organizational and Personal Information

We do not sell your information. We only use it for our own legitimate business purposes, including certain marketing activities. Our uses include:

  • providing you with products and services;
  • providing you with information about our products and services;
  • managing and improving our products, services, quality control, administration, communication, and internal processes;
  • personalizing and customizing your experience with us;
  • verifying your identity;
  • investigating any inquiries or complaints submitted by or about you in or in compliance with regulatory or legal obligations;
  • to protect us, our business partners, or our users and enforce our Terms of Use; and
  • to maintain the security of our products.

We will retain information only as long as necessary to provide SkiCam services, comply with legal obligations, or enforce our agreements.

2.2 Sharing of Organizational and Personal Information

Content uploaded to SkiCam is shared only with users authorized by the account owner, such as team Coaches, Athletes, or Parents/Guardians. We will not share your personal information with third parties, except as necessary to provide our services, to comply with the law, or to protect our rights. We may, however, disclose anonymized or aggregated versions of this information for business, marketing, or public relations purposes.

We may share personal information with third-party service providers who help us operate SkiCam. This includes, for example, AWS for data storage and Stripe for payment processing. These providers are contractually obligated to protect your information and may use it only for the services they perform on our behalf, or as required by law.

We may also disclose personal information to law enforcement, regulatory authorities, or other parties if we believe it is necessary to comply with applicable laws, respond to legal processes, detect or prevent fraud, enforce our Terms of Use, or protect the safety, rights, or security of our users or the public.

We do not sell or rent personal information to third parties for marketing purposes.

2.3 Feedback

You may be asked to provide feedback (as defined in the Terms of Use) related to our services. Provision of feedback is optional. If you choose to provide feedback, we may use your feedback in the form of a written testimonial posted online. We will not attribute such feedback directly to you without your permission.

3.0 Where We Store Your Information

3.1 Location

All information and content provided to SkiCam is stored on AWS servers located in Canada. We use industry-standard security measures to protect data in transit and at rest. Our storage practices are designed to comply with applicable privacy laws, including PIPEDA, GDPR, and COPPA where relevant.

3.2 Retention

SkiCam retains content and account data for at least 13 months and may retain it longer unless deletion is requested. Retention periods are designed to allow continued access to services, support operational needs, and comply with any legal obligations. We may update our retention policies over time, but will always maintain a minimum retention period to ensure the functionality of the SkiCam platform.

3.3 Deletion

Users, including Coaches, Athletes, or Parents/Guardians, may request deletion of their accounts or content at any time. Upon such a request, SkiCam will promptly process the deletion, permanently removing the requested information from our systems. For Athletes under 18, deletion requests may be submitted by the parent or guardian who acts as the account owner.

4.0 Parental Consent and Minors

Athletes under 18 must have parental or guardian consent to create an account and have their content uploaded. Coaches are required to confirm that consent has been obtained before creating an account or sharing videos for any minor athlete. For users under 13 in the United States, SkiCam complies with COPPA by obtaining verifiable parental consent and allowing parents to review or delete their child’s information at any time. Parents or guardians act as the account owner where required and are responsible for monitoring their child’s account activity.

5.0 Your Data Rights

Users have the following rights regarding their personal information:

  • Access and Correction: Users may review and correct their personal information.
  • Deletion and Portability: Users may request deletion or export of personal data.
  • Withdrawal of Consent: Users may withdraw consent at any time; this does not affect lawful processing prior to withdrawal.
  • European Users (GDPR): Rights include access, correction, erasure, restriction, objection, and complaint with supervisory authorities.
  • Marketing Opt-Out: Users may opt out of marketing communications where applicable.

Parents or guardians may exercise these rights on behalf of minor users.

6.0 Business Transfers

If we or our assets are acquired, or in the event that we go out of business or enter bankruptcy, we would include our user information among our assets transferred to or acquired by a third party. You acknowledge that such transfers may occur, and that any parties who acquire us may continue to use your personal information according to this policy.

7.0 Security

We take security seriously and do what we can within commercially acceptable means to protect your personal information from loss or theft, as well as unauthorized access, disclosure, copying, use, or modification. That said, we advise that no method of electronic transmission or storage is 100% secure, and cannot guarantee the absolute security of your data.

8.0 Changes to the Privacy Policy

At our discretion, we may change this policy from time to time. Any changes will be reflected here, so we encourage you to visit this page regularly. Your continued use of this site after any changes to this policy will be regarded as acceptance of our practices around privacy and personal information.

Where required by law, we will notify users of significant changes to how their personal information is used.
